PRPTY is a platform for property enthusiasts to share content and connect. By using PRPTY, you acknowledge that:

  1. All content is user-generated
  2. PRPTY does not verify, endorse, or guarantee any content
  3. You use the platform at your own risk

TERMS OF USE

1. Acceptance

By accessing or using PRPTY, you agree to these Terms. If you disagree, do not use the platform.

2. Age Requirement

You must be at least 18 years old to use PRPTY.

3. Your Account

  1. You’re responsible for your account security
  2. Don’t share your login details
  3. We can suspend or terminate accounts that violate these Terms

CONTENT UPLOAD POLICY

YOU AGREE THAT:

  1. You Own Your Content
  2. You must own or have rights to everything you upload
  3. Don’t post content that belongs to someone else
  4. This includes photos, videos, text, and any other material
  5. You’re Responsible for Your Content
  6. You are solely liable for anything you post
  7. Ensure your content is accurate and lawful
  8. Don’t post misleading property information
  9. Prohibited Content You must NOT upload:
  10. Content you don’t own or have permission to use
  11. False or deceptive property information
  12. Defamatory, offensive, or harassing material
  13. Private information without consent
  14. Anything illegal under Australian law
  15. Spam or repetitive content

Content License

By uploading content, you grant PRPTY a non-exclusive, royalty-free license to display and use your content on the platform. You retain ownership of your content.

DISCLAIMER OF LIABILITY

PRPTY IS NOT LIABLE FOR:

  1. User Content
  2. We don’t review, verify, or endorse user uploads
  3. We’re not responsible for accuracy of property information
  4. We don’t guarantee any content is current or reliable
  5. Your Actions
  6. Any decisions you make based on platform content
  7. Property transactions or investments
  8. Interactions with other users
  9. Loss or damage from using the platform
  10. Third Party Content
  11. External links or references
  12. Third party services or websites
  13. Advertisements or promotions

NO WARRANTIES

The platform is provided “as is” without any warranties. We don’t guarantee:

  1. Accuracy of any content
  2. Platform availability or functionality
  3. Fitness for any particular purpose
  4. Security of your data

AUSTRALIAN CONSUMER LAW

Nothing in these Terms excludes, restricts or modifies any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted or modified by agreement.

INDEMNITY

You agree to indemnify PRPTY, its directors, employees, and agents from any claims, damages, or costs arising from:

  1. Your content uploads
  2. Your use of the platform
  3. Your breach of these Terms
  4. Your violation of any laws or third-party rights

CONTENT REMOVAL

We reserve the right to:

  1. Remove content without notice
  2. Investigate reported content
  3. Cooperate with law enforcement
  4. Preserve content as required by law

PRIVACY

Your personal information is handled according to our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and Australian Privacy Principles.

DISPUTE RESOLUTION

  1. Try to resolve disputes directly
  2. If unsuccessful, attempt mediation
  3. Any legal action must be brought in Australian courts

MODIFICATIONS

We may update these Terms anytime. Continued use means you accept changes.

SEVERABILITY

If any provision is invalid under Australian law, other provisions remain in effect.

GOVERNING LAW

These Terms are governed by the laws of Australia and the state or territory where PRPTY operates.

CONTENT & COPYRIGHT NOTICE

YOUR RESPONSIBILITIES

Before uploading ANYTHING to PRPTY, ensure:

✓ You created it yourself OR

✓ You have written permission from the owner OR

✓ It’s genuinely in the public domain

This includes:

  1. Photos (even if you’re in them, you need photographer’s permission)
  2. Property images (need owner’s or agent’s permission)
  3. Text copied from other websites
  4. Videos or audio
  5. Maps, plans, or diagrams
  6. Logos or branding

COPYRIGHT INFRINGEMENT

If you believe someone has uploaded your copyrighted content without permission:

Include:

  1. Description of your copyrighted work
  2. Location on PRPTY where it appears
  3. Your contact details
  4. Statement that you own the copyright
  5. Statement that the information is accurate

FAIR USE DOESN’T MEAN FREE USE

Even if you credit the source, you still need permission to use others’ content. Giving credit doesn’t make it legal.

CONSEQUENCES OF INFRINGEMENT

Uploading content without permission may result in:

  1. Immediate content removal
  2. Account suspension or termination
  3. Legal action by copyright owners
  4. Personal liability for damages

PROPERTY PHOTOS & PRIVACY

  1. Don’t upload photos of private property without permission
  2. Respect privacy – avoid capturing people without consent
  3. Be mindful of security – don’t reveal sensitive property details
  4. Real estate agent photos typically require permission

PLATFORM PROTECTION

PRPTY is protected under the safe harbour provisions of Australian copyright law as we:

  1. Don’t review content before publication
  2. Act on copyright notices promptly
  3. Remove infringing content when notified
  4. Don’t have actual knowledge of infringement

However, this protection doesn’t extend to you as the uploader.

SIMPLIFIED USER AGREEMENT

By using PRPTY, you agree:

  1. I will only upload content I own or have permission to use
  2. I understand PRPTY is not responsible for:
  3. Accuracy of any content
  4. My decisions based on platform content
  5. Other users’ uploads
  6. Any losses I might suffer
  7. I accept full responsibility for my uploads
  8. I won’t hold PRPTY liable for anything that happens from using the platform
  9. I’m over 18 years old
  10. I’ll follow Australian laws
