INTRODUCTION

This Privacy Policy explains how VIANUOVA HOLDINGS PTY LTD (ABN 19 681 357 746) (“PRPTY”, “we”, “us”, “our”) collects, uses, discloses and protects personal information in connection with the PRPTY website (prpty.app) and the PRPTY mobile application, together referred to as the “Product”.

We are committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). By using the Product, you agree to the collection and use of information as described in this Privacy Policy. If you do not agree, please do not use the Product.

This Privacy Policy applies only to the Product. The Product may contain links to third-party websites or services; this Privacy Policy does not apply to those third parties, and we encourage you to review their privacy policies separately.

INFORMATION WE COLLECT

We may collect the following categories of information:

  • Account information: name, email address, username, and password.
  • Profile information: bio, property interests, and location (optional, if you choose to provide it).
  • Content: posts, comments, photos, and other material you upload or share on the Product.
  • Communications: messages, feedback, or support requests you send to us.
  • Automatically collected information: device type, operating system, IP address, and usage data (such as pages viewed and time spent).
  • Cookies and similar tracking technologies (see Section 4).

We do not knowingly collect financial account details, government identifiers, health information, or other sensitive information as defined under the Privacy Act, unless you voluntarily provide it to us in the course of using a specific feature (for example, if in-app purchases are introduced in future, payment details will be collected and processed by a third-party payment processor, not stored by us directly).

HOW WE COLLECT INFORMATION

We collect information directly from you when you register for an account, join the waitlist, complete a form, or otherwise interact with the Product. We also collect information automatically through your use of the Product, including via cookies and similar technologies.

Where the Product allows account registration, you consent to our collection of the personal information described in this Privacy Policy as part of that registration process.

COOKIES

Cookies are small files stored on your device that help us understand how the Product is used and improve your experience. Cookies do not allow us to access other information stored on your device.

Most browsers accept cookies automatically, but you can change your browser settings to control or remove cookies. If you disable cookies, some features of the Product may not function correctly.

If we introduce advertising or third-party analytics in future, those third parties may use their own cookies, which are governed by their own privacy policies, not this one.

HOW WE STORE AND PROTECT YOUR INFORMATION

No method of transmission over the internet or electronic storage is completely secure, but we take the protection of your personal information seriously and take reasonable steps appropriate to the sensitivity of the information, including:

Your data is primarily stored on servers located in Australia or with providers that maintain Australian data centres, where reasonably practicable.

HOW WE USE YOUR INFORMATION

  • Display your content to other users, as you direct.
  • Respond to enquiries and provide customer support.
  • Send important updates about the Product.
  • Improve and develop Product features.

  • Comply with our legal obligations.

We will not sell your personal information, share your email address with other users without your consent, or use your information for unrelated marketing purposes.

SHARING YOUR INFORMATION

We may share your information with:

  • Other users, but only the information you choose to make public on the Product.
  • Service providers who help us operate the Product (such as hosting and analytics providers), under confidentiality obligations.
  • Law enforcement or regulators, where required by law.
  • A new owner, in the event the Product or our business is sold, merged, or restructured.
  • Related entities, but only where those entities agree to comply with this Privacy Policy.

We do not share personal information with marketing companies or data brokers, and we do not disclose information to international organisations except where required to operate the Product or with your consent.

PUBLICLY SHARED INFORMATION

If you post or share personal information in public areas of the Product (such as your profile, comments, or posts), you do so at your own risk. We are not responsible for how other users or third parties use information you choose to make public.

DATA RETENTION

We retain your information for as long as:

  • Your account remains active;
  • We reasonably need it to provide the Product to you; or
  • We are required to retain it by law.

If you delete your account, we will remove your personal information within 90 days, except where we are required to retain certain records for legal or regulatory purposes.

YOUR RIGHTS

Under Australian privacy law, you have the right to:

  • Access the personal information we hold about you.
  • Request correction of inaccurate information.
  • Request deletion of your account and associated data.
  • Opt out of non-essential communications.
  • Lodge a complaint about how we handle your personal information.

EMAIL COMMUNICATIONS

If you receive an email from us and no longer wish to receive it, you may use the unsubscribe link included, adjust your account settings, or contact us directly. We will action opt-out requests promptly, though you may receive further correspondence while a request is being processed.

DATA BREACH NOTIFICATION

If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC), in accordance with the Notifiable Data Breaches scheme under the Privacy Act.

INTERNATIONAL USERS

The Product is designed primarily for Australian users. If you access the Product from outside Australia, your information will be transferred to and processed in Australia, and Australian privacy laws will apply, which may differ from the laws of your own country.

CHILDREN’S PRIVACY

The Product is not intended for anyone under 18 years of age. We do not knowingly collect personal information from children. If we become aware that we have collected information from a person under 18, we will delete it as soon as reasonably practicable.

MERGER, RESTRUCTURE OR SALE

If all or part of our business is merged, restructured, or sold, your personal information may be transferred as part of that transaction, subject to the acquiring party’s obligation to handle it in accordance with applicable privacy law.

CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. Material changes will be notified via email to registered users, an in-app or on-site notification, and by updating the “Last Updated” date at the top of this page. Continued use of the Product after changes take effect constitutes acceptance of the updated policy.

COMPLAINTS

If you have a complaint about how we handle your personal information:

  • Email our Privacy Officer at privacy@prpty.app. We aim to acknowledge complaints within 48 hours and resolve them within 30 business days where possible.
  • If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
